Privacy Policy for the online services provided by Wacom Technology Corporation

This Privacy Policy explains how information about you is collected, processed, used and shared by Wacom Technology Corporation, 1455 NW Irving St, Portland, OR 97209, USA (“Wacom,” “we,” or “us”) as data controller when you use the online services provided by us including those available under including those available under https://us-store.wacom.com and https://us-marketplace.wacom.com (the “Websites”).

At Wacom we take your privacy and our responsibility to protect your personal data seriously. As used in this Privacy Policy “personal data” means any information – either alone or in combination with other information we can access – that relates to you as an identified or identifiable individual. We respect your right to privacy and will only process your personal data in accordance with applicable data protection and privacy laws. This Privacy Policy applies to information we collect when you use one of our Websites and online products and services available via the Websites or when you otherwise interact with us via the Websites (collectively the “Services”).

1. Information Collection and Use

We collect certain information every time a visitor comes to one of the Websites. This information is used for specific purposes which we list below. The specific types of personal data we collect depend upon your activities on the Website.

We collect the information you provide to us, e.g. in the course of the creation of a Wacom Account, when you share a product review or a comment or when you request a certain Service. Such information may include:

    We use this information for different purposes: Providing our Services, managing the Services, improvement of our products and Services, troubleshooting bugs, improving overall performance of the Website, and performance of purchases including facilitating of respective payments and sending out order confirmations.     1.2 Information that is automatically collected

When you use one of the Websites, we may automatically collect certain information as described below for purposes such as improvement of our products and Services, troubleshooting bugs, providing the services, managing the Services and improving overall performance of the Services. Such information includes profile information, aggregate user data, preferences, technical session information, browser type, information about your computer, hardware, software, the pages you viewed on the Website and the dates and times of your visit. 1.3 Creation of and signing-in to Wacom Account

If you create or log in to a Wacom Account we use your login data (name and password) for the purpose of providing you a personal single-sign on to Services from Wacom and online services by other members of the Wacom Group.

The Wacom Account also provides you the option to use the login data of any of your social network accounts (e.g. as the case may be Facebook, Twitter, Google+) for the purpose of creating or logging into the Wacom Account (social login). In case you use a social login, the operator of the respective social network will also process your data. We are not responsible for these processing activities by the third party social network operator.

If you use the social login feature, we might receive the following personal data from the respective operator of the social network (as far as according to your personal settings those are part of your public social network profile):

We use this data for the purpose of verifying your identity and managing access to your Wacom Account.

 

2. International Data Processing

Please note that we are a company which is located in Germany but which operates globally and is part of the Wacom group of companies, the members of which are specified here (“Wacom Group”). With respect to certain parts of the Services, a co-operation between different members of the Wacom Group is established (in particular a single-sign-on procedure to the Wacom Account spanning various online services). As a consequence, certain data are shared within the Wacom Group. Without your explicit consent, such sharing of data only occurs to the extent permitted by applicable law, e.g. as far as required for the performance of the Services you are using. Therefore, personal data relating to you might be processed outside of your local jurisdiction and the European Economic Area. In particular, some of your data might be stored in the United States of America and/or Japan. However, any transfer or storage of your personal data to a location outside of the European Economic Area will continue to be in compliance with all applicable European data protection laws and this Privacy Policy. In particular, insofar as we are bound by applicable law, we will take appropriate safeguards to ensure adequate protection of the data.

 

3. Cookies

We use cookies, a standard Internet technology that allows us to store and retrieve login and other usage information for every user of our system.

Google Analytics has been supplemented by the code "gat._anonymizeIp();" in order to ensure anonymized collection of IP addresses ("IP masking").

Our Websites also use Crazyegg, an analytics service provided by Crazy Egg, Inc. ("CrazyEgg") that helps improve websites by tracking how users interact and engage. Furthermore, you can prevent CrazyEgg’s collection and use of data generated by the cookie and related to your use of the website by using the CrazyEgg Opt-out.

Our Websites also use Segment.io, a third party analytics service provided by Segment.io, Inc. ("Segment.io") to help understand your use of our Services. Segment.io analyses your use of our Website and/or Service and our relationship with you, so that we can improve our Services. Marketing Cookies: – which collect anonymous / pseudonymous information for the purpose of display advertising

On ur Websites, we might use remarketing cookies of certain display advertising service providers. These serve the purpose of displaying advertisements to those users of third party websites which have previously visited one of our Websites. For this purpose, we collect the information that a certain user has visited specific sites of our Websites. This information will be linked to a Cookie – a text file which is placed on your device by the display advertising service provider. When you visit other websites, specific advertisements regarding our offers may be displayed to you based on your past visit to our Websites.

We have integrated respective conversion tags on this website. These tags utilize cookies which were placed on your device by the display advertising service provider. When a user clicks on an ad leading to our Website, a temporary cookie is placed on his device. When you complete a certain action on this Website, this cookie will be recognized and a conversion will be recorded.

We neither have influence on which exact data will be collected by these cookies nor do we know the full extent of the data collection. 4. Sharing Data outside of the Wacom group

Wacom does not sell, rent, or share personal data to or with any third party, except if allowed by applicable data protection laws or as described in this privacy statement. We will never give or sell your personal information to be used for the purposes of sending you unsolicited commercial offers (such as spam) from any third party.

Sharing of your personal data for business reasons

We may communicate personal data to third parties as far as required for the arrangement or performance of agreements with you, i.e. when you purchase products or services via our Websites. Possible recipients might be independent software vendors from which you purchase a license or a software service via our Website.

Moreover, we may use third party service providers to offer or facilitate services on our behalf, such as an identity management provider, a payment service provider or an analytics service provider which act as data processors and therefore handle the data on our behalf. Any sharing of your personal data with such third party service providers will be made in accordance with all applicable data protection laws and will be limited to the extent necessary. In the event Wacom goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, and our customers' personal information may be part of the assets transferred, customers will be notified via prominent notice on our Website. If, as a result of the business transition, your personal data will be used in a manner materially different from that stated at the time of collection, you will be notified and – if required by applicable law – asked to provide consent.

5. Third Party Features

The Websites may contain links to or features from other websites. This Privacy Policy covers the data handling practices by Wacom, and does not cover the data handling practices of third party websites or features. Wacom is not responsible for the privacy policies and/or practices of third parties. When linking to another site or using a third party service, you should read the privacy policy on that site or for that service.

To the extent certain third party website features are available on the Website, the following terms apply. However, we advise you to nevertheless consult the respective privacy policies for detailed information.

5.1 Twitter

We may use a Twitter widget (provided by Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA) to enable users to easily share content found on the Website by sending a Tweet via their Twitter Account. By using this widget, the webpages you viewed will be connected with your Twitter account and disclosed to other users. This includes the sharing of certain information with Twitter. Please note that a data transfer is triggered already when you visit our Website, irrespective whether you interact with the plug-in. If you visit our Website whilst signed into your Twitter user account, information concerning your visit will be transferred to Twitter and Twitter can assign your visit to our Website to your user account. 7. Security

Wacom takes reasonable precautions to help protect information about you. However, given the nature of the internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information.

When registering for access to a secure area of the site, we will ask you to select a username and password. We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also, remember to sign out of the Service and close your browser window when you have finished your work.
